Cousy BV cares about your privacy. Therefore, we want to inform you as comprehensively as possible about what happens to the personal data you entrust to us. In this Privacy Policy (hereinafter: Policy) you will find all the information about what personal data we collect, why we collect it, how long we store it, what your rights are and how you can exercise them.

Who are we?

Your personal data is collected on the Cousy website, managed by Cousy BV, a company incorporated under Belgian law with its registered office at Vandendriesschestraat 10, 9620 Zottegem, Belgium and with company number BE0407.925.877.

Cousy is the controller of your personal data. This means that Cousy determines the purpose and means of processing your personal data.

Cousy BV processes your personal data for various purposes, processing only the data necessary for the intended purpose:

1. Providing goods, services and/or information you request;
2. Monitoring data downloaded from our website;
3. Measuring and monitoring the use of this website, improving the quality and content of this website;
4. Personalizing the Content and Layout of this Website;
5. Improving the products and services of Cousy BV;
6. Providing general or direct marketing to you.

The processing of personal data is necessary for the execution of the contract you may enter into with Cousy BV.
Personal data are processed within the framework of the legitimate interests of Cousy BV to process those personal data: preventing fraud or misuse of services, improving the website. In those cases, Cousy BV always strives to balance our legitimate interests with your privacy.

We make every effort to protect your privacy and personal data on our website. Cousy BV uses a combination of technical and organizational measures to secure your data.
Our employees are trained to properly handle your personal data. In addition, in the context of each project involving the processing of personal data, an assessment is carried out with regard to the security and protection of that data, always taking into account your interests. Compliance is also monitored by our employees regarding our internal information security policies, security requirements and management standards.

Do we share or sell your personal data?

We do not sell or share your personal data with third parties without your prior approval unless:

– To companies legally affiliated with Cousy BV and incorporated in the European Economic Area. Your personal data will be shared with those companies for the same purposes stated in this Policy. Those companies are considered joint controllers in this context;
– To a legal successor who takes over Cousy BV in part or in full;
– To authorized financial or banking institutions whose intervention is necessary for the smooth running of the payment process;
– To credit reporting agency employees. We reserve the right to request information about you from other third parties, such as credit reporting agencies (Graydon – Companyweb). We will add that information to information we have already processed. This allows us to (1) offer you goods or services; (2) help prevent money laundering and fraud. If we make such a request, we will first inform you of it and let you know whether the request will be stored in a credit file;
– If we are required to do so by law, or if we believe it is necessary to prevent fraud or Internet crime, or to protect our website or someone’s right, property or personal safety;
– As needed to provide you with our services. Some of our database is accessed by or transmitted to third parties working on our behalf who assist us in providing you with our products and services. These include, for example, our service providers for web hosting, cloud services or maintenance services. This statistical data does not contain any information that identifies you.

When such processing goes beyond the scope of the purposes determined by Cousy BV, the third party is fully responsible for such processing and Cousy BV can in no way be held responsible or liable for such processing.

What are your privacy rights and how can you exercise them?

You have the right to access, rectify or erase (“right to oblivion”) your personal data. In addition, you have the right to object to the use of your personal data for direct marketing purposes. You also have the right to request a copy of all your personal data that we process, to the extent technically feasible. You also have the right to data portability.

To exercise those rights or to request more information about your rights, please email info@cousy.be. In order to exercise your right to access and to prevent any unauthorized disclosure of your personal data, your identity must be verified. In case of doubt or ambiguity, we will first ask you for supplementary information (e.g. copy of your identity card).

You may exercise your privacy rights free of charge unless your request is manifestly unfounded or excessive, especially of because of its repetitive nature. In this case, we have the right and the choice – in accordance with the General Data Protection Regulation – to charge you a reasonable fee (in light of the administrative costs of providing the requested information or communication) or to reject your request.

If you submit your request electronically, the requested information will be provided to you electronically if possible, unless otherwise requested by you. In any case, we will give you a concise, transparent, clear and easy-to-understand answer.
We will respond to your request as soon as possible, in any case within one month of receiving your request. Depending on the complexity of the request and the number of requests, that deadline may be extended for an additional two months if necessary. In that case, we will notify you of such an extension within one month of receiving the request.

Finally, you have the right to complain to a local supervisory authority or to the Belgian Data Protection Authority (our lead supervisory authority) in connection with the processing of your personal data by Cousy BV.

How long will your personal data be kept?

By law, we are not permitted to keep personal data longer than necessary for the purpose for which the data was collected. Therefore, the retention period may vary depending on the earth of processing. Some examples: generally, we will store your personal data for five years after your most recent contact request.

Finally, we must keep your data for a certain period of time in order to comply with a number of local laws, in view of our accounting and tax obligations.

After the applicable storage period has expired, your personal data will be deleted or rendered anonymous.

How do you stay informed of changes to this Policy?

Cousy BV reserves the right to modify, amend, supplement or delete all or part of this Policy at any time and in its sole discretion. This may be necessary given market evolutions or new processing activities we undertake. Therefore, we ask that you check regularly to see if this Policy has changed.
